Former Special Agent In Charge of The New York FBI Counterintelligence Division Charged With Violating U.S. Sanctions On Russia

A Russian Court and Government Interpreter Is Also Charged with Violating U.S. Sanctions on Russia
Damian Williams, the United States Attorney for the Southern District of New York, and Michael J. Driscoll, Assistant Director in Charge of the New York Field Office of the Federal Bureau of Investigation (“FBI”), announced the unsealing of a five-count Indictment charging CHARLES MCGONIGAL and SERGEY SHESTAKOV with violating and conspiring to violate the International Emergency Economic Powers Act (“IEEPA”) and with conspiring to commit money laundering and money laundering. SHESTAKOV is also charged with making material misstatements to the FBI. The defendants were arrested on Saturday evening, and they will be presented this afternoon before Magistrate Judge Sarah L. Cave in Manhattan federal court. The case has been assigned to U.S. District Judge Jennifer H. Rearden.

U.S. Attorney Damian Williams said: “As alleged, Charles McGonigal, a former high-level FBI official, and Sergey Shestakov, a Court interpreter, violated U.S. sanctions by agreeing to provide services to Oleg Deripaska, a sanctioned Russian oligarch. They both previously worked with Deripaska to attempt to have his sanctions removed, and, as public servants, they should have known better. This Office will continue to prosecute those who violate U.S. sanctions enacted in response to Russian belligerence in Ukraine in order to line their own pockets.”

FBI Assistant Director in Charge Michael J. Driscoll said: “The FBI is committed to the enforcement of economic sanctions designed to protect the United States and our allies, especially against hostile activities of a foreign government and its actors. Russian oligarchs like Oleg Deripaska perform global malign influence on behalf of the Kremlin and are associated with acts of bribery, extortion, and violence. As alleged, Mr. McGonigal and Mr. Shestakov, both U.S. citizens, acted on behalf of Deripaska and fraudulently used a U.S. entity to obscure their activity in violation of U.S. sanctions. After sanctions are imposed, they must be enforced equally against all U.S. citizens in order to be successful. There are no exceptions for anyone, including a former FBI official like Mr. McGonigal. Supporting a designated threat to the United States and our allies is a crime the FBI will continue to pursue aggressively.”

According to the allegations contained in the Indictment unsealed today in Manhattan federal court:[1]

In 2014, the President issued Executive Order 13660, which declared a national emergency with respect to the situation in Ukraine. To address this national emergency, the President blocked all property of individuals determined by the U.S. Treasury to be responsible for or complicit in actions or policies that threatened the security, sovereignty, or territorial integrity of Ukraine, or who materially assist, sponsor, or provide support to individuals or entities engaging in such activities. Executive Order 13660 and regulations issued pursuant to it prohibit making or receiving any funds, goods, or services by, to, from, or for the benefit of any person designated by the U.S. Treasury.

On April 6, 2018, the United States Department of the Treasury’s Office of Foreign Assets Control (“OFAC”) designated Oleg Deripaska as a Specially Designated National (“SDN”) in connection with its finding that the actions of the Government of the Russian Federation with respect to Ukraine constitute an unusual and extraordinary threat to U.S. national security and foreign policy (the “OFAC Sanctions”). According to the U.S. Treasury, Deripaska was sanctioned for having acted or purported to act on behalf of, directly or indirectly, a senior official of the Government of the Russian Federation and for operating in the energy sector of the Russian Federation economy.

CHARLES MCGONIGAL is a former Special Agent in Charge (“SAC”) of FBI’s Counterintelligence Division in New York, who retired in 2018. While working at the FBI, MCGONIGAL supervised and participated in investigations of Russian oligarchs, including Deripaska. SERGEY SHESTAKOV is a former Soviet and Russian diplomat who later became a U.S. citizen and a Russian interpreter for courts and government offices.

In 2021, MCGONIGAL and SHESTAKOV conspired to provide services to Deripaska, in violation of U.S. sanctions imposed on Deripaska in 2018. Specifically, following their negotiations with an agent of Deripaska, MCGONIGAL and SHESTAKOV agreed to and did investigate a rival Russian oligarch in return for concealed payments from Deripaska. As part of their negotiations with Deripaska’s agent, MCGONIGAL, SHESTAKOV, and the agent attempted to conceal Deripaska’s involvement by, among other means, not directly naming Deripaska in electronic communications, using shell companies as counterparties in the contract that outlined the services to be performed, using a forged signature on that contract, and using the same shell companies to send and receive payments from Deripaska.

MCGONIGAL and SHESTAKOV were aware that their actions violated U.S. sanctions because, among other reasons, while serving as SAC, MCGONIGAL received then-classified information that Deripaska would be added to a list of oligarchs considered for sanctions as part of the process that led to the imposition of sanctions against Deripaska. In addition, in 2019, MCGONIGAL and SHESTAKOV worked on behalf of Deripaska in an unsuccessful effort to have the sanctions against Deripaska lifted. In November 2021, when FBI agents questioned SHESTAKOV about the nature of his and MCGONIGAL’s relationship with Deripaska’s agent, SHESTAKOV made false statements in a recorded interview.

CHARLES MCGONIGAL, 54, of New York, New York, and SERGEY SHESTAKOV, 69, of Morris, Connecticut, are charged with one count of conspiring to violate and evade U.S. sanctions, in violation of the IEEPA, one count of violating the IEEPA, one count of conspiring to commit money laundering, and one count of money laundering, each of which carries a maximum sentence of 20 years in prison. SHESTAKOV is also charged with one count of making false statements, which carries a maximum sentence of five years in prison.

The maximum potential sentences are prescribed by Congress and are provided here for informational purposes only, as any sentencing of the defendants will be determined by the judge.

Mr. Williams praised the outstanding work of the FBI New York Field Office’s Counterintelligence Division and the valuable assistance from U.S. Customs and Border Protection as well as the New York City Police Department.

The case is being prosecuted by the Office’s Public Corruption Unit. Assistant U.S. Attorneys Hagan Scotten, Rebecca T. Dell, and Derek Wikstrom are in charge of the prosecution with assistance from Trial Attorney Scott A. Claffee of the National Security Division’s Counterintelligence and Export Control Section.

The charges contained in the Indictment are merely accusations, and the defendants are presumed innocent unless and until proven guilty.

Appeal Court annuls APC’s governorship primaries in several local governments

The Court of Appeal in Makurdi has ordered the All Progressives Congress, APC, to conduct a fresh primary election in 11 out of the 23 local government areas of Benue State for the nomination of its gubernatorial candidate.

The affected local governments are, Gboko, Gwer- East, Gwer-West, Guma, Katsina-Ala, Logo, Makurdi, Otukpo, Ukum, Tarka and Vandeikya.

The court also asked that APC conduct the primaries within 14 days and that INEC recognize the winner after adding election results from the 12 local government areas.

The development is coming barely 33 days before the 2023 general elections.

The judgement followed an appeal filed by one of the aspirants on the platform of the APC, Professor Terhemba Shija, arguing that there was no valid primary election held on 27th May 2022 by APC for the nomination of its gubernatorial candidate to warrant Fr Alia emerging as the winner.

The court, after examining the evidence submitted by Professor Shija, agreed with his submissions.

The Court agreed with APC on the rerun of 9th June 2022, which took part in 12 local governments of the states, saying it was valid and still stands.

The court dismissed Senator Barnabas Gemade’s appeal and upheld the judgement of the Federal High Court, which dismissed his suit against Fr Alia for being statute-barred.

How Atiku will become the next president By Dele Momodu

I have read with bemusement many of the polls about the forthcoming Presidential election on February 25, 2023, and have come to the conclusion that the elitist polls have failed monumentally due to the over-reliance on technology in a largely illiterate population.

I have decided to help situate the forecasts based on the established polical history of Nigeria and empirical data.

A Presidential candidate cannot depend totally on votes from outside his home base to win this election. It is a fact of history that whenever the South produced two strong candidates, the dominant Nothern candidate won, such as in 1979 and 1983, Obafemi Awolowo and Nnamdi Azikiwe versus Shehu Shagari.

Bola Tinubu is far weaker today in the South West and Awolowo was by far more formidable, while Obi is the new Azikiwe (the first Governor General and President of Nigeria) in the South East, and Kwankwaso is the current Aminu Kano.

Atiku Abubakar will dominate the North East, North West, North Central and South South. Tinubu may pick a few states in the North and South West but won’t have enough to win. The bridges required to cross to victory has taken Atiku 30 years to build. Tinubu has not been able to lock down the entire South West not to talk of the whole of Nigeria. Over-reliance on bribing the electorates will fail. Hoping to rig brazenly will also fail spectacularly. I repeat, the entire North and the South South will make Atiku the next President. Atiku will still be competitive in the South East and South West. Wherever Obi is number one in the East, Atiku will be number two. Wherever Tinubu is number one in the South West, Atiku will be number two or vice versa. Atiku will be the first to cross the line of recording 25 percent in 24 states. He will get 25 percent automatically in the 19 states of Northern Regions and will pick six in South South automatically. He will pick more 25 percent in all of the five states in the South East, a traditional base of PDP, and same in the South West. Wherever Obi is number one, Atiku will be number two or vice versa. I do not know of any state PDP will not record 25 percent and eventually win the overall popular votes. Nigeria has become so polarizingly divided (pardon my tautology) that the “peoples” are going to vote majorly along ethnic lines as well as primordial sentiments. The North will not vote a “fake Muslim” in the name of a pretentious and mischievous Muslim/Muslim ticket. The scam is dead on arrival. The North East will never vote for a number two position when they’ve been chasing the number one since 1966. The North West will not abandon an Atiku for a Tinubu who’s well known for his iron grip on Lagos State since 1999. The South West itself knows it has the most controversial and palpably weakest candidate in this race this time and would humbly and readily accept its fate with equanimity. It will also dawn on the South East that Obi’s raving popularity alone cannot carry him across the winning line and many of their traditional voters will willingly settle for ATIKU ABUBAKAR and IFEANYICHUKWU OKOWA, the cerebral man and gentle giant of Igbo ancestry. I predict that former President Atiku Abubakar will be the next President of the Federal Republic of Nigeria. He is the most prepared, experienced candidate in the race who’s ready to hit the ground running from day one…
Nigerians will experience real politicking in the days ahead.

PDP remains the best option for Igbos, says Chidoka

Osita Chidoka, achieftain of the Peoples Democratic Party, PDP, and former minister of aviation, has said the South-East geo-political zone should back the party in the 2023 elections, claiming that it would be unwise for Igbos to desert a political party they have supported since 1999.

Chidioka also claimed that the Labour Party presidential candidate, Peter Obi, who is from the zone, will disrupt PDP’s dominance in the South East.

Mr Chidoka said this on Sunday while fielding questions on the Channels Television’s Sunday Politics programme.

“The Igbo position for me is that our significant investment in the PDP for 24 years cannot be thrown away overnight. I remain in the PDP, and many Igbos remain in the PDP,” Chidoka said.

He said that supporters of an Igbo presidency outside the PDP are not wrong, but maintained that the main opposition party is the shortest route for the Igbos to clinch the presidency.

Atiku says he will complete Niger’s Baro Inland Port

The Presidential Candidate of the Peoples Democratic Party (PDP), Alhaji Atiku Abubakar, has promised to complete the Baro inland seaport in Niger.

Abubakar also pledged to tackle insecurity across the country, if elected in the upcoming general elections.

He made the promises on Saturday in Minna, while inaugurating his presidential campaign in the state.

“I promise to tackle insecurity and complete the uncompleted Baro inland seaport in Niger state, if you vote for me in the presidential election,” he said.

The Baro seaport in Agaie Local Government Area of the state started under the PDP administration of late President Umaru Yar’adua from 2007 to 2010, but has not been completed.

Besides, Abubakar promised to accord priority to federal road infrastructure and education sector of the country, if given the mandate.

Similarly, Sen. Iyorcha Ayu, the PDP National Chairman, urged the people of the state to vote for the party in the polls based on the developmental strides of the former PDP governors of the state; late Alhaji Abdulkadir Kure and Dr Babangida Aliyu.

“You have to call the people of Niger state to come out en masse and vote for the PDP because of the massive development you witnessed under past administrations of our party,” he said.

Also, Alhaji Liman Kantigi, the PDP governorship flag-bearer in the state, promised to tackle insecurity and give priority to the education sector of the state.

Dr Babangida Aliyu, a former governor of the state, said that a vote for Abubakar in the presidential election is a vote for a better Nigeria.

Aliyu, therefore, appealed to the people of the state to vote for the PDP in the elections in order to ensure a secure, united, and prosperous Nigeria.

Earlier, Mr Tanko Beji, the state PDP Chairman, assured the party that the people of the state would vote for the PDP in the general elections.
